  • OF THE PROCESSING OF PERSONAL DATA

    Capris S.A. applies the Law on Protection of Personal Data, to further guarantee transparency in the processing of your personal data.

    When it is necessary for the User to register or provide personal data (among other cases, to access services; request information; acquire products; send queries, complaints or hiring requests; send curriculum vitae), the collection and processing of data data will be carried out in accordance with and in compliance with the principles set forth in Law No. 8968 Protection of the Person against the Treatment of their Personal Data and its current Regulation, regarding the protection of natural persons with regard to the treatment of personal data and the free circulation of these data.

    Capris S.A. undertakes to process and collect personal data:

    • Lawfully, loyally and transparently,
    • appropriately, pertinently and limited to what is necessary,
    • exactly updated and for the necessary time.

    Likewise, Capris S.A. is committed to adhering to the guiding principles of Privacy by Design and by Default and Proactive Responsibility. In any case, the data collected will be transferred to the information systems that are the responsibility of Capris S.A. for the sole purpose of:

    • Manage the relationship with the Users, as well as the provision of Services offered through the Web (or about which the User has made a query/request) and, in general, the management, development and fulfillment of the relationship established between Capris S.A. and those who provide their personal data through the Website.
    • Solve doubts and queries.
    • Make targeted shipments, in case you have given us your consent, to periodically inform you of news, products and services both by written and electronic means (telephone, email, virtual office, app, sms, etc.) and of which you will have the possibility of unsubscribing.
    • When personal data is collected through the form, it will be necessary for the User to provide, at least, those marked with an asterisk, since, if these data considered necessary are not provided, Capris S.A. will not be able to manage the requested service.
    • In addition, with the delivery of the data and/or with the completion of the form(s), the User expressly authorizes Capris S.A. use the email address or telephone as a means of communication and guarantees that the data provided is true, exact, complete and up-to-date, expressly consenting to the use, treatment and communication of these for the informed purposes.
    • In the event that the User does not wish to receive electronic commercial communications in the future or unsubscribe from the newsletter system to which they have been able to subscribe, they may express such wish by sending an email to the following email address: serviciocliente@capris .cr (in addition, in each shipment the possibility that the User can unsubscribe will be established).
    • Capris S.A. It has profiles on some of the main social networks on the Internet (Facebook, Instagram, Whatsapp, among others), so that it is responsible for the treatment in all these cases of the data of its followers, fans, subscribers, commenters. The treatment that Capris S.A. can carry out will be the one that the social network allows to corporate profiles. Capris S.A. You can inform your followers by any means that the social network allows about your activities, services, etc. In no case Capris S.A. will extract data from social networks, unless users provide us with the information by consent.

    In addition, in relation to the processing of your data, Capris S.A. reports:

    • The legal basis for the treatment of your data is the execution of the contract and provision of the services detailed in your invoice.
    • Regarding the rest of the purposes, it is based on the consent that is requested, without in any case the withdrawal of this consent conditioning the execution of the contract.

    • Your personal data will be kept for the duration of the contractual and commercial relationship, or you request its deletion. Once the contractual relationship has ended, we will keep your personal data blocked during the legal prescription periods, once these have elapsed, we will proceed to its elimination.

    • Your data is not transferred to any third party, unless we are bound by any mandatory regulations or legislation.

    In relation to your rights when you provide us with your data, you must know the following:

    • You have the right to know if we are treating your data and, where appropriate, to know what personal data of your ownership we are treating.

    • You have the right to rectify any personal data that is inaccurate.

    • Under certain circumstances, you may request the deletion of your data.

    • In certain circumstances, you will have the right to request us to limit the processing of your data, in which case we inform you that we will only keep them for the exercise or defense of claims.

    • You will have the right to receive, in electronic format, the personal data that you have provided us and those that have been generated during the contractual relationship, as well as to transmit them to another entity.

    • In certain circumstances and for reasons related to your particular situation, you will have the right to oppose the processing of your data in which case, we would stop processing them except for compelling legitimate reasons, or the exercise or defense of possible claims.

    Regarding the prices

    Capris S.A. applies the Law on Protection of Personal Data, to further guarantee transparency in the processing of your personal data.

    • All prices shown on our website include the corresponding VAT.

    • The price of the equipment does not include installation and/or transportation costs.

    • The prices do not include expenses for shipments abroad and nationalization at destination, which must be assumed 100% by the buyer.

    • If the product was delivered by third parties (parcel) at the request of the buyer, the product will travel at the expense and risk of the buyer.

    • The prices indicated in the technical sheets (downloaded in pdf, printed or sent to the email) apply only if the purchase is made through the website. These prices are exclusive for purchases at www.capris.cr and cannot be applied in other sales channels of the company.

    • The printed prices of the website will be verified in the same at the time of the presentation of the document, if the purchase is not made through the website Capris reserves the right to grant or not the price indicated in the print if the date of this.

    • The price that is stipulated through a special negotiation with the Seller assigned to the client prevails over any other discount assigned to the product (discount for online purchases, for example).

    • Discount coupons do not apply to products with a special price.

    • Two or more coupons cannot be applied to the same purchase.

    • Free transport coupons do not apply with the DHL shipping method. 

    • Free transport coupons do not apply with international shipments. 
    • The discount coupon do not apply to wholesale client.
    • All information related to offers and combos of our products through the website, including prices, are presented in good faith. If any inconsistency or involuntary error is detected when publishing the prices or any other component of the offer to the public on the purchasing platform, the correction will proceed immediately, and if it affects the order, the customer will be informed of said situation. In the case of a derisory price, Capris reserves the right to eliminate the product affected by the derisory price in the order. A "derisory price" is considered a price that is insignificant because it is small or that moves laughter and ridicule, according to the definition of "derisory" by the Royal Spanish Academy. In the event that a refund of money already paid applies, the refund will be made.

    Regarding returns

    • The maximum time for product return is 8 calendar days, after the invoice is issued by CAPRIS S.A.
    • You must present the original purchase receipt for any returns.
    • No damaged packaging is received, nor product altered or opened by third parties.
    • Returns are not accepted for cable or chain that has been cut at the request of the customer.

    Regarding payment by credit and/or debit card

    • We accept all credit and debit cards (national and international). Except American Express (AMEX).
    • In case you have made the transaction and we do not have the stock in the inventory, you will be contacted by a Capris official to coordinate the shipment of an alternative product or refund of the money.
    • The data and/or information related to credit cards will be handled only by the company BAC SAN JOSE, so our server will not capture said data, it will only record the data of the client and the sale operation carried out.

    Regarding deposits or bank transfers

    • The accounts to use this form of cancellation www.capris.cr are:

    • The invoice will be made once the proof of deposit or transfer is received to the email ventas@capris.co.cr addressed to the E-Commerce / Capris Department, and the income to said accounts is verified with our Treasury department.

    Regarding the credit with Capris

    • To be able to buy on credit on our website, you must be a client with an open account in Capris and have the VIP option enabled.
    • To make purchases through the page you must be an active customer and your credit situation must be up to date.
    • The payment term for credit purchases is 30 days, unless there are expressly different payment conditions noted on the invoice. In accordance with article 460 of the Commercial Code, the invoice is enforceable against the buyer for the discount balance. The invoice will accrue default interest of 4% per month, without prejudice to the suspension of credit and without this meaning an extension of the term.

    Regardingthe shipping methods

    • Withdrawal at Capris Technical Warehouse. It has no cost. The Delivery Schedule for Web Orders is Monday through Friday from 7:00 a.m. to 5:00 p.m. to 7:00 p.m. Saturdays 7:00 a.m. to 12:00 a.m.
    • By regular transport from Capris, we deliver in 48-72 hours within the Greater Metropolitan Area (GAM). Additional cost to be paid by the buyer: ¢3955 VAT included. Orders will be dispatched in a delivery schedule from Monday to Friday from 8:00 am. to 5:00 pm according to the route of the corresponding day.
    • Correos de Costa Rica: Additional cost to be paid by the buyer: ¢5085 VAT included. Capris is not responsible for the delivery time of the package when using this shipping method.
    • DHL: The system will tell you before finalizing your purchase the amount to pay for using this shipping method. (Applies to local shipments or abroad, in the latter the prices do not include nationalization expenses at destination, which must be assumed 100% by the buyer).

    Regarding the shipping methods

    • The formalization of the purchase will depend on the confirmation of the stock of the products in the inventories by Capris S.A.
    • The client or the contac person in his case, will receive the product at the address indicated. You can consign a third party (contact person) as the recipient of the product, in which case the full name of the consignee, the ID number, the exact address where to make the delivery, and a reference or contact telephone number must be clearly indicated.
    • The products will be dispatched in a delivery schedule from Monday to Friday from 8:00 am. to 5:00 pm according to the route of the day that corresponds to the indicated destination.
    • High parts inventory is maintained, however, discontinued products have limited parts inventory. Please read the conditions of said inventory in liquidation.

    Regarding the guarantees

    • The warranty period starts from the date of purchase of the product and the invoice indicates the warranty period applicable to the product.
    • The guarantee holds Capris S.A. responsible. to repair or replace the parts as previously assessed by the Service Center at the facilities of Capris S.A. If a visit to the client's facilities is required, the client must bear the costs of the visit.
    • The replacement of the parts or spare parts by guarantee will be carried out as long as the defects are due to manufacturing problems or deficiency in any of the parts.
    • The equipment can be designed for heavy, light or domestic work, so it must be used under the working conditions specified by the manufacturer, this includes the work environment, optimal installation and correct maintenance.
    • The guarantee is subject to conditions of normal use of the equipment and does not apply in cases of operator negligence, or that the equipment has suffered abuse or misuse.
    • If the equipment is repaired, disassembled or modified by unauthorized persons, the guarantee loses its validity.
    • The price of the equipment does not include installation and/or transportation costs, unless it is stated literally on the invoice.
    • It is the responsibility of the user to give the correct maintenance to the equipment (lubrication, cleaning, oil changes, filter changes, etc.).
    • The guarantee does not apply to consumables (coals, oils, nozzles, electrode holders, gaskets, filters, fibers, roles, hoses, etc.) or due to normal wear and tear of the equipment.
    • Electronic equipment that requires specialized software (aligners, automotive scanners and others) require updates and/or expansions every six months, the costs and responsibility of which will be assumed by the client.

    Regardingthe security of the website

    • Our site www.capris.cr has a VeriSign Secure Site Pro SSL certificate of 128-bit authenticity issued by VeriSign Trust Network, in the name of Capris.S,A, which allows establishing a secure communication channel between the client and our server, encrypting the information transmitted over the Internet between them, using a 1024-bit RSA public key.

    • Our website has a secure server under the HTTPS Hypertext Transfer Protocol Secure protocol, intended for the secure transfer of hypertext data, that is, it is the secure version of HTTP.
